The Office of the Governor: Svalbard (Sysselmesteren)

The Sysselmester pΓ₯ Svalbard is a unique entity in the Norwegian system. It combines the roles of Statsforvalter (Civil Governor) and Police Chief into one person. The current Governor is Lars Fause, a former prosecutor known for his strict interpretation of Svalbard's unique legal status.

1. The "No Social Safety Net" Policy

The most critical risk for families on Svalbard is the official policy that Svalbard is not a cradle-to-grave society.

  • Deportation for Care Needs: Unlike the mainland, if a family struggles (e.g., a child develops special needs, or parents lose their income), the Governor has the power to expel them to the mainland. Fause has strictly enforced the rule that anyone who cannot "care for themselves" has no right to stay.
  • No Barnevern Infrastructure: There is no full-service Barnevern on Svalbard. Serious cases are handled by the mainland (TromsΓΈ), meaning a child removal often involves an immediate flight 1000km away, severing all contact instantly.

2. The Dual-Role Conflict (Police + Governor)

On the mainland, the Statsforvalter supervises the Police. On Svalbard, the Governor IS the Police Chief.

  • Lack of Checks and Balances: If you file a complaint about police misconduct on Svalbard, you are essentially complaining to the same office that committed the act. Critics and legal scholars have long warned that this fusion of power weakens legal security (rettssikkerhet) for residents.
  • Record Criminal Cases (2024/2025): Under Fause’s leadership, the number of criminal cases has hit record highs, driven by aggressive policing of field regulations. This strict "law and order" approach leaves little room for social nuance.

3. The "Habilitet" (Impartiality) Trap

Because the community in Longyearbyen is tiny (approx. 2500 people), conflicts of interest are rampant.

  • Everyone Knows Everyone: The Governor drinks at the same pub as the people he investigates. Fause himself previously resigned from a prosecutor role to avoid conflicts of interest, showing he is aware of the danger. However, structural issues remain: how can a Governor impartially oversee a "local council" (Longyearbyen Lokalstyre) that consists of his neighbors and friends?.
Do Better Norge Verdict: Svalbard is a "rights vacuum" for vulnerable families. Lars Fause acts as a Sheriff-Governor with powers that would be illegal on the mainland. If you are a parent on Svalbard facing a child welfare or health crisis, you must understand that the Governor's primary tool is exclusion, not assistance. The "best interest of the child" on Svalbard is often interpreted as "sending the child away."
